1. Who we are
LateralDeck is a product operated by Kuma Partners, registered in Portugal. LateralDeck is developed and managed by Sven Mulfinger.

For all legal, privacy, and contractual matters, Kuma Partners acts as the data controller and service provider.
2. Acceptance of terms
By accessing or using LateralDeck, you confirm that you have read, understood, and agree to these Terms of Service. If you do not agree, do not use the service.
LateralDeck is intended for professional use only. You must be at least 18 years old to use this service. By using LateralDeck, you confirm that you meet this requirement.
3. What LateralDeck is
LateralDeck is a real-time collaborative tool designed to facilitate structured thinking exercises for remote and in-person teams. It allows a session host to create a session, invite participants, and distribute lateral thinking cards to stimulate creative problem-solving.
4. Your account and sessions
LateralDeck does not require user accounts or registration. Sessions are identified by a room code and expire automatically after 24 hours. You are responsible for keeping your room code secure and for all activity that occurs within sessions you host.
5. Acceptable use
You agree to use LateralDeck only for lawful purposes and in a way that does not infringe the rights of others. You must not:
- Use LateralDeck to harass, harm, or discriminate against any person
- Attempt to access, disrupt, or reverse-engineer the service or its infrastructure
- Use LateralDeck to collect or process sensitive personal data of other users beyond what the service is designed for
- Impersonate any person or organisation within a session
- Use automated tools, bots, or scripts to interact with the service
6. Intellectual property
All content within LateralDeck — including card prompts, design, text, and methodology — is the intellectual property of Kuma Partners and is protected under applicable copyright law. You may not reproduce, distribute, or create derivative works from LateralDeck content without prior written permission from Kuma Partners.
7. Subscriptions and payments
LateralDeck currently offers free access. In the future, paid plans and subscription tiers will be introduced. When payment features are launched, the following will apply:
- Prices will be displayed clearly in Euros (EUR) inclusive of applicable taxes
- Subscriptions will be billed on a recurring basis (monthly or annual) as selected at purchase
- You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period with no partial refunds
- Kuma Partners reserves the right to change pricing with at least 30 days notice to existing subscribers
- Payments will be processed by a third-party payment provider; Kuma Partners does not store payment card details
- If a payment fails, access to paid features may be suspended until payment is resolved
These payment terms will be updated and presented for acceptance at the time paid features are introduced.
8. Data protection and GDPR
Kuma Partners is the data controller for personal data processed through LateralDeck. We are committed to compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and applicable Portuguese data protection law.
Legal basis for processing: We process personal data on the basis of legitimate interest (Article 6(1)(f) GDPR) to provide the session functionality you have requested, and on the basis of contract (Article 6(1)(b) GDPR) for paid subscribers.
Data minimisation: We collect only the data strictly necessary to operate the service — your first name, session participation data, and chosen thinking style. No email address, password, or sensitive personal data is required to use the free service.
Data retention: All session data is automatically and permanently deleted after 24 hours. Paid subscriber billing data is retained for the period required by Portuguese tax law (currently 10 years).
Your rights under GDPR: As a data subject you have the right to access, rectification, erasure, restriction of processing, data portability, and the right to object. To exercise any of these rights, contact us at info@neurodisruptors.com. You also have the right to lodge a complaint with the Portuguese data protection authority (CNPD — Comissão Nacional de Proteção de Dados) at www.cnpd.pt.
International transfers: Session data is stored on Supabase infrastructure. Where data is transferred outside the European Economic Area, such transfers are conducted under appropriate safeguards in accordance with GDPR Chapter V.
9. Limitation of liability
LateralDeck is provided "as is" without warranties of any kind. Kuma Partners does not guarantee uninterrupted or error-free service. To the maximum extent permitted by Portuguese and EU law, Kuma Partners shall not be liable for any indirect, incidental, or consequential damages arising from your use of LateralDeck.
For paid subscribers, Kuma Partners' total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
10. Changes to these terms
Kuma Partners reserves the right to update these Terms of Service at any time. We will notify users of material changes by displaying a notice within the app. Continued use of LateralDeck after changes are posted constitutes acceptance of the revised terms.
11. Governing law
These Terms of Service are governed by and construed in accordance with the laws of Portugal. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Portugal, without prejudice to any mandatory consumer protection rights you may have under EU law.
